Absconder in Pakistan:
An absconder in Pakistan is a person who willfully avoids his arrest or court proceedings. Whenever a person is required by the court or by the law enforcement agencies in Pakistan, the person has to be present before them. If the person willfully avoids his presence, then there can be legal consequences. The law has given some coercive means to the court and the law enforcement agencies for the production of a person before them. A person cannot willfully avoid his presence; otherwise, he has to face the legal consequences. There are two types of absconders in Pakistan as follows.
POLICE ABSCONDER:
When a person is required by the police and he deliberately avoids the police, then his name is added to the absconder list in Pakistan. At any random check anywhere in Pakistan, if his ID is checked and he is on the absconder list, then he will be arrested at the same place.
COURT ABSCONDER:
When a person is required by the court in a case or trial and he willfully avoids his presence before the court, the court directs his name to be added to the absconder list. Before a person’s name is added to the absconders list, the court follows the complete legal procedure. The court issues a warrant for his appearance, and in case he is not arrested, then after the proclamation, his name is added to the absconders list.
CONSEQUENCES OF ABSCONDING:
There are certain consequences of absconding in Pakistan. A person who absconds in Pakistan can face the following consequences.
Ø CANNOT TRAVEL:
Any absconder cannot travel within Pakistan or outside Pakistan. If he tries to go abroad, he will be stopped and arrested at immigration at the airport. If he tries to travel within Pakistan, he will not be issued any ticket, and he will be arrested on the spot.
Ø CANNOT OPEN BANK ACCOUNT:
An absconder in Pakistan cannot open any bank account. As per the new bank policy, a person who is a proclaimed offender cannot open or operate any bank account in Pakistan. In some situations, the previous bank accounts can also be frozen.
Ø CAN BE ARRESTED ANYWHERE:
As a consequence, an absconder in Pakistan can be arrested anywhere in the country. Such a person can be arrested in any city or province of Pakistan.
Ø CAN BE ARRESTED BY ANYONE:
An absconder can not only be arrested by the police, but the law also allows that the absconder can also be arrested by any person. For example, you or I also have the power to arrest an absconder.
Ø ATTACHMENT OF PROPERTY:
The property of an absconder can also be attached by the court if he fails to appear before the court.
Ø BLOCKED ID CARD:
The ID card of an absconder can also be blocked by the court and the law enforcement agencies.
Ø TRIAL IN ABSENTIA:
If a person is declared an absconder, his trial can also be conducted in his absence, which is called trial in absentia.
Ø BAIL BECOMES DIFFICULT:
A person who willfully avoids the courts and the police—for such a person, the courts make his bail hard.
