COMMON LAW MARRIAGE IN PAKISTAN

COMMON LAW MARRIAGE MEANING:

A common law marriage meaning as defined, is a contract between the couple to live together on certain terms and conditions without being legally married to each other. A common law marriage is not a legally recognized marriage, but in common law marriage, the couple enters into a contract to live together as a husband a wife on such terms and conditions as they decide themselves. In some countries, the state gives every citizen the right to enter into any type of contract. These countries or states give the right to live together as husband and wife without being legally married to each other. Common law marriage in Pakistan is not legally recognized and is considered a crime. Pakistan does not recognize any affidavit of common law marriage or any common law marriage divorce. Court marriage in Pakistan is not a common law marriage.

COMMON LAW MARRIAGE IN PAKISTAN:

Common law marriage in Pakistan is considered to be null and void. In Pakistan, either you get married or you don’t get married. There is no such thing as a living relationship or common law marriage divorce. As it is not recognized in Pakistan, there is no point in asking for the affidavit of common law marriage or for common law marriage documents. In Pakistan, common law marriage is a crime. In Pakistan, you cannot enter into this type of contract of living relationship. If anyone cohabits without validly being married with a Nadra marriage certificate, he or she may be criminally punished for committing Zina.

AFFIDAVIT OF COMMON LAW MARRIAGE:

Affidavits of common law marriage are required in those countries or states where common law marriage and divorce are legal. There are some countries and states all over the world that recognize common law marriage. These countries obtain affidavit of common law marriage divorce. The requirements of common law marriage documents are different in different countries and states. As a contract for common law marriage, the couple may decide any terms and conditions that they think are good for them.  There is no such thing as a common-law marriage or divorce in Pakistan.

COMMON LAW MARRIAGE DIVORCE:

The countries and states that recognize common law marriage also recognize common law marriage divorce. The partners who enter into the contract of a living relationship also decide the mode of divorce between them. The partners, like in any civil contract, can decide in this common law marriage contract how the contract can be dissolved. The dissolution of a contract does not mean the dissolution of marriage in Pakistan, as Pakistan considers this type of contract void abnitio.

COMMON LAW MARRIAGE DOCUMENTS:

Pakistan does not legally recognize common law marriage, so there is no point asking a Pakistani law about the common law marriage documents. In those countries where the common law marriage is valid, you may ask a lawyer in those countries or states about the common law marriage documents. The common law marriage meaning, in short, a contract of living relationship, is a crime in Pakistan. Even if someone enters into a contract of common law marriage in Pakistan and registers it abroad by way of online marriage in Pakistan, it will still be invalid in Pakistan.
