FOREIGN DIVORCE DECREE
A foreign divorce decree means the court’s final orders and judgment in a divorce case issued from some other country’s court. The recognition of foreign divorce decrees is given by the law in almost all the countries. There might be some requirements for judicial recognition of foreign decrees in some countries. Some countries have also kept some requirements for the validity of foreign decrees. You may also ask a lawyer of that country how to register a foreign divorce decree. A female doesn’t have to conduct a khula procedure in Pakistan again if she has a valid court order from abroad. In Pakistan, there is no restriction on the acceptance of divorce orders from the courts of other countries. If the court order says that the spouse is divorced now, then the law does not ask the spouse to get divorce again. The law only does not accept the court orders from those countries, which the Pakistani government does not even recognize as a country. Like if someone has a court order of divorce from Israel, the law will not accept it.
Requirements for Judiciary Recognizance:
The requirements for judicial recognition of foreign divorce decrees depend on the law of each country. Each country has the right to make its own law and set its own requirements. Some of the countries accept the court orders without any requirement, and some accept them with some of the requirements. In Pakistan, if you have court orders from abroad, we require that such orders be attested from the ministry of foreign affairs of such country. Validity of a Foreign Divorce Decree:
The validity of a foreign divorce decree may be changed in each country. In Pakistan, we don’t check the validity. As per the law of Pakistan, once it is divorced, it does not get expired. Even once you have the divorce certificate in Pakistan, it is forever. The word validity indirectly means an expiry date. The divorce and the marriages in Pakistan do not have any expiry date on them. Once you are married in Pakistan, we don’t ask people to get married again due to the validity of the paper, as it does not make any logical sense.
