Is Khula Halal in Islam

IS KHULA HALAL IN ISLAM:

Some Islamic scholars preach that khula in Islam is not permissible. It is only because of a lack of knowledge. Those scholars say that only the qazi can grant the khula to the female. In English, the qazi is called a judge. The judge and the qazi are the same person. The female has the right in Islam to get a divorce from her husband, which is called khula. In Islam, the male doesn’t need a reason to give a divorce to his wife, but the wife does. If the wife needs khula from her husband, she needs to have a valid reason. This reason should be proved in court by a lawyer. There is a difference in procedure in different countries if a female needs a divorce. For example, for khula in Pakistan, you need to file a case in the family court through a lawyer.

Is khula halal in Islam? It is sometimes asked by the females who listen to the scholars, who themselves lack the knowledge of Islam. In Islam, marriage is a contract, and if a female doesn’t want to continue with this contract, she can file a case in court. The case is to be filed through a lawyer. If the lawyers prove the reasons for divorce in the court, the court will grant the khula decree to the wife. In some countries, the khula decree from the court is final; however, in some countries, like Pakistan, the khula is not finalized after the khula decree. After the khula decree, there is a grace period of 90 days, also known as the iddat period. During this iddat period, the husband and wife can have a compromise.

Compromise Between the Husband & Wife:

If the compromise between the husband and the wife does not take place within 90 days, then after these 90 days, the divorce certificate in Pakistan is issued. This certificate is proof that the couple is now divorced. A female in Pakistan does not get a divorce through a court decree. In Pakistan, a female is said to be divorced only when the divorce certificate is issued. The female can also get a conditional divorce by the court. The court can set a condition on the khula decree for the wife to obtain the divorce certificate. For example, the court can order the khula decree on the condition of the return of the dower amount taken by the wife. The wife, as per this court order, will be issued the certificate only when she returns the dower amount.
