Marry With & Without Wali:

When a person marries with or without their wali, they are issued a Nadra marriage certificate in Pakistan. This marriage certificate is from the government software. This certificate is legally issued because the legal formalities for the marriage were complete. The legal formalities in Pakistan do not require the approval of the wali. Even if you religiously check what the faraiz of the nikah are, it does not say the approval or consent from the wali. Religiously, the faraiz includes only three things, as below.

  • Ø  There should be a male and a female.
  • Ø  Two witnesses
  • Ø  Offer and acceptance of nikah in the presence of witnesses.

The above are the only three faraiz of the marriage. These faraiz do not include the approval or the consent from the wali. It does not mean that the mother or the father should not be in the marriage. It only means that it is optional if the mother or the father of the bride or the groom is present at the marriage or not. Religiously, if the mother or the father of the bride or the groom is not present or even if they don’t give their approval for the marriage, the marriage will still be valid religiously and legally.
